General Terms and Conditions of Sale
Art. 1 – General Provisions
1.1. By browsing this area, the user accesses www.eleanornitti.com, available at the URL: www.eleanornitti.com (hereinafter referred to as “Eleanor Nitti”). Browsing and submitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site as stated herein.
1.2. These General Terms and Conditions of Sale apply exclusively to the sale of products purchased on the site in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code (Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree 70/03) by:

1.3. Before accessing the products provided by the site, the user is required to read these General Terms and Conditions of Sale, which are deemed to be fully and unequivocally accepted at the time of purchase.
1.4. Users are invited to download and print a copy of the purchase form and these General Terms and Conditions of Sale, the terms of which Eleanor Nitti reserves the right to modify unilaterally and without prior notice.

Art. 2 – Subject
2.1. These General Terms and Conditions of Sale govern the offer, submission, and acceptance of purchase orders for products on Eleanor Nitti and do not govern the provision of services or the sale of products by parties other than the seller that may be present on the same site via links, banners, or other hyperlinks.
2.2. Before placing orders and purchasing products or services from third parties, we recommend checking their terms of sale.
Art. 3 – Conclusion of the Contract
3.1. To complete the purchase contract, the user must fill out the electronic form and submit it following the relevant instructions.
3.2. The form includes a reference to the General Terms and Conditions of Sale, images of each product and its price, available payment methods, delivery methods and costs, a reference to the conditions for exercising the right of withdrawal, and the procedures and timing for returning purchased products.
3.3. Before concluding the contract, the user will be asked to confirm that they have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and personal data processing.
3.4. The contract is concluded when the seller receives the completed form from the user, after verifying the accuracy of the data contained therein.
3.5. The user is obliged to pay the price from the moment the online order submission procedure is completed. This occurs by clicking the “Place Order” button at the end of the guided procedure.
3.6. Once the contract is concluded, the seller will process the order.
Art. 4 – Registered Users
4.1. When completing the registration procedures, the user agrees to follow the instructions on the site and to provide accurate and truthful personal data.
4.2. Once registered, the user will receive a confirmation email at the address provided. Confirmation must be communicated within one day. After this period, if confirmation is not received, Eleanor Nitti will be released from any obligation towards the user.
4.3. Confirmation releases Eleanor Nitti from any responsibility regarding the data provided by the user. The user agrees to promptly inform Eleanor Nitti of any changes to their data at any time.
4.4. If the user provides inaccurate or incomplete data, or if there are disputes regarding payments made, Eleanor Nitti reserves the right to not activate or to suspend the service until the issues are resolved.
4.5. Upon the first request to activate a profile, Eleanor Nitti will assign the user a username and password. The user acknowledges that these credentials constitute the access validation system and the only system to identify the user, and that actions performed using such access will be attributed to them and will be binding.
4.6. The user agrees to keep their access credentials confidential, to store them with due care and diligence, and not to share them, even temporarily, with third parties.
Art. 5 – Product Availability
5.1. Product availability refers to actual availability at the time the user places the order. However, this availability is purely indicative, as products may be sold to other customers before the order is confirmed due to simultaneous site access by multiple users.
5.2. Even after the order confirmation email is sent, cases of partial or total unavailability of goods may occur. In such cases, the order will be automatically adjusted by removing the unavailable product, and the user will be immediately informed via email.
5.3. If the user requests cancellation of the order, thereby terminating the contract, Eleanor Nitti will refund the amount paid within 7 working days from the moment Eleanor Nitti becomes aware of the buyer’s decision to terminate the contract.

Art. 7 – Payment Methods and Prices
7.1. Product prices are those indicated on the site at the time of the order, unless there is an obvious error.
7.2. In case of error, Eleanor Nitti will notify the buyer as soon as possible, allowing confirmation of the order at the correct price or cancellation. In any case, Eleanor Nitti is not obliged to sell the product at the lower incorrect price.
7.3. Prices on the site include VAT. Prices may change at any time. Changes do not affect orders for which confirmation has already been sent.
7.4. Shipping costs are borne by the user and vary depending on the contents of the cart. The user will always be informed of the shipping cost at checkout.
7.5. Once the desired products and services are selected, they will be added to the cart. Simply follow the purchase instructions, entering or verifying the required information at each step. Order details may be modified before payment.
7.6. Payment can be made by credit/debit card. Payment details must be entered at the time of the order using a valid credit or debit card, such as Visa or Mastercard (American Express is not accepted). The amount will be charged immediately, and Eleanor Nitti reserves the right to verify the card’s validity and solvency. Based on the results, Eleanor Nitti reserves the right to refuse the order.

Art. 8 – Delivery
8.1. Eleanor Nitti ships throughout the Italian territory, excluding the Vatican City State and the Republic of San Marino. Delivery will not be made to the following territories: ________.
8.2. Deliveries will be made worldwide.
8.3. Eleanor Nitti only delivers to the address provided by the user at the time of purchase.
8.4. For deliveries within Italy, shipping is generally carried out within 2–5 business days, or, if no specific delivery date is indicated, within the estimated timeframe selected during checkout and, in any case, within a maximum of thirty days from the order confirmation date.
8.5. For EU countries, delivery will be made within 3–7 business days, and in any case, within a maximum of thirty days.
8.6. For non-EU territories, delivery will be made within 10–14 business days.
8.7. If delivery is not possible, the order will be sent to the warehouse. In such cases, a notice will specify the location of the order and how to arrange a new delivery.
8.8. If you are unable to be present at the delivery location at the agreed time, please contact us again to arrange a new delivery date.
8.9. If delivery cannot take place for reasons beyond our control after thirty days from the date the order is available for delivery, we will assume the contract is to be terminated.
8.10. Upon termination, the amounts will be refunded, including delivery costs, excluding any additional costs resulting from the choice of a delivery method other than the standard one offered, without undue delay and, in any case, within 7 business days from the termination date. Transport costs resulting from contract termination may be charged to the buyer.
8.11. Shipping costs are borne by the buyer and are clearly indicated at the time the order is placed.
Art. 9 – Transfer of Risk
The risks related to the products pass to the buyer upon delivery. Ownership of the products is acquired once full payment of all amounts due, including shipping costs, is received, or upon delivery if it occurs later.
Art. 10 – Warranty and Commercial Conformity
The seller is responsible for any defects in the products offered on the site, including non-conformity of the items to the ordered products, in accordance with Italian law.
If the buyer has entered into the contract as a consumer—meaning any natural person acting on the site for purposes unrelated to any business or professional activity—the warranty is valid provided that the defect appears within 24 months from the delivery date; that the buyer submits a formal complaint regarding the defect within a maximum of 2 months from the date the defect was recognized; and that the online return form is correctly completed.
In case of non-conformity, the consumer buyer has the right to restore the conformity of the products at no cost, through repair or replacement, or to obtain an appropriate price reduction or contract termination for the disputed goods and a refund of the price.
All return costs for defective products will be borne by the seller.
Art. 11 – Withdrawal
11.1. In accordance with current legal provisions, the buyer has the right to withdraw from the purchase without penalty and without specifying the reason, within 14 days pursuant to Article 52 of Legislative Decree 206/2005, starting from the date of receipt of the products.
11.2. In the case of multiple purchases made by the buyer with a single order and delivered separately, the 30-day period starts from the date of receipt of the last product.
11.3. Users wishing to exercise the right of withdrawal may do so by accessing the “returns” section on the Eleanor Nitti website and creating a request.
11.4. Users may also send an email, indicating the order number and their name, to the following address:

11.5. The buyer must exercise the right of withdrawal by sending an explicit statement of the decision to withdraw from the contract or alternatively by submitting the standard withdrawal form referred to in Annex I, Part B, Legislative Decree 21/2014 (not mandatory).

11.7. Goods must be returned intact, in the original packaging, complete in all parts and with the accompanying tax documentation. Subject to verification of compliance, the site will refund the amount of the returned products within a maximum of 7 business days, including any shipping costs incurred by the user.
11.8. Return shipping costs are borne by the user.
11.9. As provided by Article 56, paragraph 3 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014, the site may withhold the refund until the goods are received or until the buyer provides proof of having returned the goods.
11.10. The right of withdrawal does not apply if Eleanor Nitti’s products and services fall within the categories listed in Article 59 of Legislative Decree 206/2005.
11.11. The site will issue the refund using the same payment method chosen by the buyer at the time of purchase. In the case of payment by bank transfer, and if the user wishes to exercise the right of withdrawal, they must provide the necessary bank details: IBAN, SWIFT, and BIC.
Art. 12 – Data Processing
12.1. Buyer data is processed in accordance with the regulations on personal data protection, as specified in the dedicated section containing the information pursuant to Article 13 of Regulation (EU) 2016/679 (Privacy Policy).
Art. 13 – Severability Clause
13.1. If any clause of these General Terms and Conditions of Sale is found to be invalid for any reason, this shall not affect the validity and enforceability of the remaining provisions.

Art. 15 – Applicable Law and Jurisdiction
15.1. These General Terms and Conditions of Sale are governed by and interpreted in accordance with Italian law, without prejudice to any overriding mandatory provisions of the buyer’s country of habitual residence. Accordingly, the interpretation, execution, and termination of the General Terms and Conditions of Sale are subject exclusively to Italian law.
15.2. Any disputes relating to or arising from these terms shall be subject to the exclusive jurisdiction of the Italian courts. In particular, if the user qualifies as a Consumer, disputes shall be resolved by the court of the user’s place of residence or domicile, in accordance with applicable law.
